Your privacy is important to us at Flex Assistant. This policy explains how we collect, use, store, and share personal information when you use our Services.

OVERVIEW

26th Street Inc., and our affiliates (Flex Assistant) and subsidiaries (“we,” “us,” “ours” or “Flex Assistant”) is an AI company that trains AI bots. 26th Street / Flex Assistant primarily provides property management companies and property owners (each, a “Property Manager”) with artificial intelligence leasing and resident assistant services, including bots (“Services”) via the Flexassistant.ai. The Services may include artificial intelligence and machine learning technologies (collectively, “AI Technologies”). Property Managers communicate with residents, prospective residents and other individuals through our Services, including by email, phone, text message, and webchat. We record these communications and use them for the purposes stated in this Privacy Policy, including to provide and improve the Services.

This privacy policy (“Privacy Policy”) explains how we collect, process, store and share information that identifies, relates to, describes, is reasonably capable of being associated with or could reasonably be linked, directly or indirectly, with a particular individual or household (“Personal Information”). Personal Information does not include information publicly available from government records, or which is not personal, like anonymous, deidentified or aggregated data (even if it originally comes from Personal Information). This Privacy Policy also provides you with important information about your Personal Information rights and how to exercise them.

This Privacy Policy covers how we treat Personal Information that we acquire from you or other sources related to our Services or other interactions with us. This Privacy Policy does not apply to Property Managers’ use of Personal Information or any third-party websites, applications or services that you access or connect with through the Services. We do not have control over the privacy practices or the content of Property Managers or third parties, or their websites, applications, products or services. As such, we are not responsible for the privacy practices employed by or content provided by Property Managers or third parties, including, websites, applications or services linked to or accessible from or in connection with our Services. Please consult the applicable Property Manager or third-party privacy policy and terms of service for information on their privacy practices and uses of Personal Information. Please also make any privacy requests directly to Property Managers or third parties with respect to Personal Information in their control.

By using, interacting with, or accessing our Services, or by providing your Personal Information to us:

You acknowledge that you accept our privacy practices and policies outlined in this Privacy Policy;

You consent to us collecting, processing, storing and sharing your information as described in this Privacy Policy;

You acknowledge that you may communicate with bots powered by generative artificial intelligence when you use the Services;

You consent that you will not disclose the Personal Information of another individual to us, or make it available on the Services, unless you have the prior written consent of the person who is the subject of the information and such person is 18 years of age or older, and you acknowledge and agree that to the extent you provide another individual’s Personal Information to us or use it in the Services, you are responsible for compliance with all applicable laws concerning such Personal Information; and

You consent to us recording and using all of your communications made through the Services – including by email, phone, text message and webchat.

PERSONAL INFORMATION WE COLLECT

We may collect your Personal Information in various ways, such as when you visit our websites, use the Services, upload information and data into our systems, enter into a transaction or contractual arrangement with us, participate in our programs or activities (e.g., our presentations, road shows, online webinars etc.), contact our customer service, or make any other inquiries or communications with us. We may also collect your Personal Information from other sources, including Property Managers and third-party vendors or service partners. This section details the categories of Personal Information that we collect, process, store, and share with third parties, including within the prior 12-month period.

GENERAL CATEGORIES OF PERSONAL INFORMATION WE COLLECT

We collect, process and store, and may share with third parties, the following general categories of Personal Information, which may be contained in, or otherwise reflected by, records that are uploaded to our platform in connection with the Services.

Personal Information and Identifiers, such as your full name, alias, date of birth, signature, postal address, email address, phone number, government identification numbers (including, for example, social security number, driver’s license or state identification number, passport number, or tax identification number), insurance policy number, credit or debit card numbers, bank account numbers, bank statements, or physical characteristics or descriptions;

Characteristics of protected classifications under California or federal law, such as your age, gender and/or sex, family size or marital status, disability, veteran, or immigration status, or other characteristics of protected classifications that we may infer or collect based on information you provide to our Services;

Commercial information, such as your records of personal property, products, residential rental or lease, or services purchased, obtained, or considered, or other purchase or consumption history or tendencies, or your prior and current rent payments, transactions, defaults, and/or evictions;

Internet or other electronic network activity information, such as your account information (including username and password), browsing and search history, online identifiers, domain name, Internet Protocol (IP) addresses, cookie data, webpage interactions, referring webpage/source through which you accessed the Services, non-identifiable request IDs and statistics associated with the interaction between your device or browser and the Services, device information (including the type of device, operating system, device settings, application IDs, unique device identifiers and crash data), or other Services usage or preferences data (including your log-on activity, consents for text messages, date and time of visits, search terms, views, clicks and downloads, including which Property Managers, people, features, content and links you interact with when using the Services);

Geolocation data, such as the city where your device is located;

Audio, visual or electronic information, such as voice recordings of your interactions with our Services or customer support specialists or photographs of your face (including those on government-issued identification cards);

Professional or employment-related information, such as your employer’s name and company affiliation, job title, professional contact information, and employment history;

Education information that is not publicly available, such as your enrolment or school records, financial aid and scholarship records, or student ID numbers;

Sensitive Personal Information, which may include information in the following categories:

Government-issued identifiers, such as your social security, driver’s license, state identification card, or passport number;

Financial information, such as your account log-in, financial account, debit or credit card number in combination with any required security or access code, password, or credentials allowing access to an account;

Precise geolocation, which includes the specific location of your device;

Certain characteristics of a protected classification, such as your citizenship or immigration status;

The content of your mail, email, and text messages not directed to us, such as communications you transmit to a Property Manager through our Services, including your rental or lease preferences, or, in cases where Property Managers use a Flex Assistant virtual assistant, access credentials for email inboxes and calendars connected to the Services and the contents thereof; and

Inferences drawn from Personal Information listed in this section; for example, to create a profile of an individual’s preferences and characteristics for marketing, communications, or Services delivery purposes.

CATEGORIES OF PERSONAL INFORMATION WE COLLECT SPECIFICALLY FOR OUR AI LEASING SERVICES

Our AI Leasing Services leverage artificial intelligence technology to facilitate a prospective tenant’s tour of a residential community. Our Identity Verification Services help facilitate identity verification in connection with a prospective tenant’s tour of a residential community. In addition to the categories outlined in the above section entitled “General Categories of Personal Information We Collect”, we may also collect, process and store, and may share with third parties, the following categories of Personal Information in connection with the Flex Assistant Leasing and/or Identity Verification Services, as applicable, which may be contained in, or otherwise reflected by, records that are uploaded to our platform in connection with the AI Leasing and/or Identity Verification Services:

Personal Information and Identifiers, such as (i) your payment and financial information, including your credit or debit card numbers and other payment details that you provide to us in connection with your tour, which we may use and store (both on our own and on vendors’ systems) these details for processing payments from you as permitted by the applicable Terms of Use, (ii) your physical characteristics and description, which we may indirectly collect from your identification cards or from photos or videos uploaded by you or taken of you in connection with your tour of a residential community and (iii) your social security, driver’s license, state identification card, or passport numbers, which we may collect and use to verify your identity;

Audio, visual or electronic information, such as voice recordings of your interactions with our Services or customer support specialists, photographs of your face (including those on government-issued identification cards), or photographs or videos taken of you in connection with your tour of a residential community or verification of your identity. We may also obtain, store (either locally or in the cloud of a vendor), access and use (in each case, by ourselves or with third parties) images, recordings and other information from technology including, without limitation, doorbell video cameras and other recording devices that may detect motion near their location and that may be located in certain leasing offices of residential communities for which we provide AI Leasing Services, which we may use to determine when you commence and leave a tour and obtain and leave the keys to the unit(s) you are touring;

Sensitive Personal Information such as your social security, driver’s license, state identification card, or passport numbers, financial account log-in or debit or credit card number in combination with any required security or access code, password, or credentials allowing access to an account, or precise geolocation. and biometric information that we may use to uniquely identify you in connection with your tour or verification of your identity. Additionally, in order to verify your identity in connection with your tour of a residential community or for other identity verification services we provide, our third party vendors may process certain biometric information, including photographs of your face which may then be shared with us or Property Managers. We or Our third party vendors, as applicable, will obtain additional consents with respect to biometric information to the extent required by applicable law.

CATEGORIES OF PERSONAL INFORMATION WE COLLECT SPECIFICALLY FOR OUR APPLICATIONS SERVICES

Our Applications Services leverage artificial intelligence technology to facilitate a prospective tenant’s application for a specific residential unit. In addition to the categories outlined in the above section entitled “General Categories of Personal Information We Collect”, we may also collect, process and store, and may share with third parties, the following categories of Personal Information in connection with the Flex Assistant Applications Services, which may be contained in, or otherwise reflected by, records that are uploaded to our platform in connection with the Applications Services:

Personal Information and Identifiers, such as (i) your social security, driver’s license, state identification card, or passport numbers, which we may collect from or share with third party vendors to verify your identity, (ii) your credit score or other indicator of creditworthiness, payroll and income information, credit or debit card numbers, and bank statements and bank account information, which we may collect from or share with third party vendors to verify your financial status and history, and (iii) your criminal and/or housing court records and reports which we may collect from or share with third party vendors to verify your criminal and/or housing history;

Professional or employment-related information, such as your employer name and company affiliation, job title, professional contact information, and employment history, which we may collect from or share with third party vendors to verify third party vendors to verify your employment status and history;

Commercial information, such as your prior rent payments, transactions, defaults, and evictions which we may collect from or share with third party vendors to verify your rental history; and

Audio, visual or electronic information, such as voice recordings of your interactions with our Services or customer support specialists or photographs of your face (including those on government-issued identification cards), which may be used to verify your identity and prevent fraud;

Sensitive Personal Information, such as your social security, driver’s license, state identification card, or passport numbers, and your financial account log-in or debit or credit card number in combination with any required security or access code, password, or credentials allowing access to an account. Additionally, in order to verify your identity in connection with your lease application, our third-party vendors may process certain biometric information, including photographs of your face, which may then be shared with us or Property Managers. We or our third-party vendors, as applicable, will obtain additional consents with respect to biometric information to the extent as required by applicable law.

CATEGORIES OF PERSONAL INFORMATION WE COLLECT SPECIFICALLY FOR OUR APP

Our App means the feature of the Services that enables (i) access to a mobile application that interoperates with certain Services to manage service requests, facilitate communication with residents, and track time, and (ii) functionality to assign and schedule work orders to technicians. In addition to the categories outlined in the above section entitled “General Categories of Personal Information We Collect”, we may also collect, process and store, and may share with third parties, the following categories of Personal Information in connection with the App, which may be contained in, or otherwise reflected by, records that are uploaded to our platform in connection with the App:

Precise Geolocation, which may be collected from your mobile device in connection with your use of the App to facilitate the assignment and scheduling of work orders;

Professional or employment-related information, such as your employer (or contracting entity) name and company affiliation, job title, professional contact information, specializations, and property assignment/coverage; and

The content of your email and text messages not directed to us, such as communications you transmit to a resident through our Services.

SOURCES OF PERSONAL INFORMATION

We collect Personal Information about you from the following categories of sources:

Directly from you, such as when you access or use our Services or when you communicate or interact with us in any way, including by mail, email, phone, text message, webchat, QR code or social media;

Indirectly from you, for example, we collect cookie data and other information from your device, browser or activity on the internet or in our Services;

From our third-party vendors, for example, from our analytics providers or third-party verification providers for our Applications Services; and

From Property Managers or other users of our Services.

CATEGORIES OF PARTIES WITH WHOM WE SHARE YOUR PERSONAL INFORMATION

We may share, and in the prior 12-month period did share, your Personal Information with the below parties:

Property Managers who control how we collect and process the Personal Information we collect from users of the Services on their behalf. Property Managers are considered “controllers” or “owners” of such Personal Information under applicable privacy law, and are not considered third parties under applicable privacy law or this Privacy Policy. As discussed above, please consult the applicable Property Manager’s privacy policy for more information on how the Property Manager uses your Personal Information;

Our Vendors who help us provide, improve, and enhance the Services or perform business functions on our behalf, including hosting, technology and communication providers, analytics providers; support and customer service vendors, vendors with whom we connect via API, third parties who facilitate the provision of our Applications Services (including, but not limited to, Consumer Reporting Agencies and employment, identification, and criminal history verification vendors) and our AI Leasing Services, our attorneys, advisors, auditors and accountants, and payment processors;

Parties You Access, Authorize or Authenticate, including third parties you access through the Services, such as identity, employment, criminal history, and payment verification service providers, information provided to such third parties are subject to such third parties’ privacy policies; please consult the applicable third party’s privacy policy before providing information to a third party;

Parties for Legal Purposes, including governmental authorities, law enforcement or other third parties in connection with any of the activities set forth in the bullet beginning with "Meet legal and compliance requirements” in the below section entitled, “How We Use Personal Information”;

Parties for Business Changes, for example, your Personal Information that we collect may be shared with or transferred to a third party if we undergo a merger, acquisition, sale, equity or debt financing, bankruptcy or other transaction in which a third party invests in, finances, or acquires control of our business or assets (in whole or in part); and

External Parties to Enforce Our or Others’ Rights, for example, your Personal Information may be disclosed to third parties to the extent necessary to protect our rights, privacy, safety, or property, you, and others, or may be disclosed to third parties to enforce our rights under our Master Services Agreement or any other binding legal agreements to which we are a party.

HOW WE USE PERSONAL INFORMATION

This section details how we use, and how in the prior 12-month period we did use, your Personal Information. This section also outlines the business purposes for which we collect, process, store and/or share your Personal Information.

Provide and protect our Services, including to provide the Services to Property Managers and interact with other users (such as prospective residents) through the Services on behalf of the Property Managers; customize the Services; prevent or address service errors, security or technical issues; analyze and monitor usage, trends or other activities; respond to requests and inquiries from, or otherwise communicate with, Property Managers, users and third parties.

Improve our Services and AI Technologies, including to carry out internal research and development; troubleshoot, test and conduct data analysis; update, improve and train the algorithms, models and functionality of the Services and AI Technologies; and develop new products, services and features.

Improve your user experience, for example, we use cookies and other device and internet information to track your search criteria or other usage data to provide content of interest to you or to store your information so that you do not need to re-enter it each time that you login.

Market to you, including through profiling, for example, to market and advertise properties to you on behalf of Property Managers; and to create a profile of you (including “profiling,” meaning the automatic processing of your Personal Information to identify your preferences and interests).

Deidentify Personal Information, including aggregating and anonymizing Personal Information so that it is no longer Personal Information.

Support our everyday operations, including using third-party vendors and service providers for business purposes (such as hosting, technology and communications).

Fraud Prevention, including verifying your identity in connection with the AI Leasing and/or Applications Services.

Meet legal and compliance requirements, including to perform audits, monitoring and reporting; support information security and anti-fraud operations; investigate and respond to disputes; exercise and defend legal claims; protect the rights, property or safety of you, us or a third party; respond to legal process (including subpoenas) and governmental, court or law enforcement requests, investigations or orders; and comply with and enforce applicable laws, regulations, policies, procedures and agreements.

Evaluate or conduct business changes, including a merger, acquisition, sale, equity or debt financing, bankruptcy or other transaction in which a third party invests in or acquires control of our business or assets (in whole or in part).

We use Sensitive Personal Information only as reasonably necessary, such as to provide, improve, and protect our Services, process payments, prevent and mitigate fraud or other illicit, malicious, or deceptive practices (including, for example, through the use of identification verification processes), ensure the integrity, safety, and security of our systems, and to ensure persons’ physical safety.

We do not sell or share your Personal Information. We do not sell Personal Information, nor do we share Personal Information with third parties for third parties’ direct marketing, cross-context behavioral advertising, or targeted advertising purposes. For purposes of this Privacy Policy, “sell” means the disclosure of Personal Information to a third party in exchange for money or other valuable consideration. In some states, the use of cookies and tracking technologies may be considered “sharing” of personal information under applicable privacy law. For more information on our use of cookies, please see the section Our Use of Cookies below.

We only share telephone opt-in data and consents with applicable Property Managers. We do not share text messaging opt-in data and consent with any third parties except the Property Managers who own or operate the property or properties relevant to a given opt-in or consent and own that data.

RETENTION OF PERSONAL INFORMATION

We retain Personal Information about you for as long as we deem necessary or advisable for the purposes described in the above section called, “How We Use Personal Information” (such as providing the Services to Property Managers) or as directed by Property Managers. For example, upon the termination of our agreement with a Property Manager, upon such Property Manager’s written request, we will delete names, emails, and phone numbers of prospective residents and residents associated with such Property Manager that are not contained in the body of the emails, text messages, and/or comment box submissions. We may maintain your Personal Information after you have stopped using or interacting with our Services; for example, we may retain your Personal Information to improve our Services, comply with legal obligations or resolve disputes or collect fees owed.

With respect to biometric data, a subcategory of Sensitive Personal Information, we or a third party store, transmit, and protect from disclosure biometric identifiers using reasonable care and in a manner that is the same as or more protective than the manner in which we or such third party stores, transmits, and protects any other confidential information that we or the third party possesses. Biometric identifiers are destroyed within a reasonable time following capture but no later than one year after the purpose of its collection has expired or to provide the services for which the biometric data was obtained, to the extent required by applicable law.

PERSONAL INFORMATION OF CHILDREN

You must be 18 years of age to use the Services. By accessing or using the Services, you represent and warrant to us that you are at least 18 years of age.

We do not knowingly collect, process, store or share Personal Information about children under 18 years of age. If you are a child under the age of 18, please do not attempt to access or use the Services or send us any Personal Information. If we learn we have collected Personal Information from a child under 16 years of age, we will delete that data as quickly as possible. If you believe that a child under 16 years of age may have provided Personal Information to us, please contact us at hello@flexassistant.ai.

To our knowledge, we do not sell or share for cross-contextual behavioral advertising or targeted advertising purposes the Personal Information of children under the age of 16.

NOTICE OF YOUR PERSONAL INFORMATION RIGHTS

Subject to exemptions and limitations provided by applicable law, you have the right to:

Request that we disclose certain information to you about our collection and use of your Personal Information (collectively, the following constitute the "right to know"):

Whether or not we are processing your Personal Information;

The categories of your Personal Information we have collected;

The categories of sources for your Personal Information we have collected;

Our business purposes for collecting or sharing that Personal Information;

The categories of third parties with whom we shared your Personal Information, identifying the Personal Information categories that each category of recipient obtained and the purposes for sharing your Personal Information;

The types of personal data we shared with third parties for third parties’ direct marketing purposes and the identities of such third parties (the “right to know third-party marketing”); and

The specific pieces of Personal Information we collected about you and access to that Personal Information (the “right to access”).

Request a copy of the Personal Information you provided to us in a portable, and, if feasible, readily usable format (the “right to data portability”);

Request that we delete any of your Personal Information that we collected from you and retained, subject to certain exceptions under applicable privacy law (the "right to delete");

Correct inaccurate or complete incomplete Personal Information (the “right to correct”);

Direct us not to share your Personal Information for the purposes of making automated decisions, including profiling, that produce legal or similarly significant effects concerning you such as decisions that result in the provision or denial of housing (the “right to opt out of profiling with legal effects”);

Limit the use or disclosure of your sensitive Personal Information to just those actions necessary to perform specific purposes outlined by law (the “right to limit use of sensitive information”); and

Be free from unlawful discrimination for exercising your rights under applicable privacy law.

HOW TO EXERCISE YOUR PERSONAL INFORMATION RIGHTS

To exercise the rights described above, you or your Authorized Agent (defined below) must send us a written request (via one of the methods described below) that (1) provides sufficient information to allow us to verify that you are the person about whom we have collected Personal Information, and (2) describes your request in sufficient detail to allow us to understand, evaluate and respond to it. Each request that meets both of these criteria will be considered a “Valid Request.” We may ask for information to verify your identity, such as your name, phone number, email address, and postal address. We will only use Personal Information provided in a Valid Request to verify your identity and complete your request. You do not need an account to submit a Valid Request.

Please be aware that certain Services or features or functionality of the Services may be unavailable to you if we honor your requests with respect to certain privacy rights (such as rights to delete or limit).

We will work to respond to your Valid Request promptly within the timeframes required by applicable privacy law (usually between 15 to 45 days depending on the type of Valid Request, with the right for us to extend the response time as necessary). We will not charge you a fee for making a Valid Request unless your Valid Request is excessive, repetitive or manifestly unfounded. If we determine that your Valid Request warrants a fee, we will notify you of the fee and explain that decision before completing your request.

You may update or correct your account information at any time by logging in to your account

You may also authorize an agent (an "Authorized Agent") to exercise your rights on your behalf. To do this, you must provide your Authorized Agent with written permission to exercise your rights on your behalf, and we may request a copy of this written permission from your Authorized Agent when they make a request on your behalf.

In some instances, we may not be able to honor your request. For example, we may not honor your request if we cannot verify your identity or if we cannot verify that you have the authority to make a request on behalf of another individual. Additionally, we may not honor your request where not required to do so under applicable privacy laws. For example, we may deny a deletion request if the information is necessary for us to provide the Services to you or comply with our legal obligations and compliance policies. We may deny a right to know request made more than twice in a 12-month period or for information collected and disclosed more than 12 months ago. We will advise you in our response if we are not able to honor your request.

You have the right to appeal our decision to not honor your request or our refusal to take action on a request within a reasonable period of time by contacting us at the email listed above and clearly stating that the purpose of the contact is an “appeal of privacy rights.” Within 45 days of receipt of an appeal, we will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions.

THE RIGHT TO LODGE A COMPLAINT WITH A SUPERVISORY AUTHORITY

Subject to applicable privacy law, should you wish to report a complaint or if you feel that we have not addressed your concern in a satisfactory manner, you have the right to lodge a complaint with your local data protection authority and/or competent supervisory authority. USE OF GENERATIVE AI BOTS IN OUR SERVICES; YOU CONSENT TO US RECORDING YOUR COMMUNICATIONS

Our Services use bots powered by generative artificial intelligence to communicate with you by email, phone, text message and webchat. You acknowledge that you may communicate with bots when using the Services.

We monitor, record, and use communications made through the Services, including email, phone, text message and webchat. This includes monitoring your keystrokes while you are using the Services, which our approved third parties may use for their own purposes such as improving their services and their AI technologies. You also consent to us and our approved third parties monitoring and recording all of your activities and communications made through the Services and to us using and sharing such recordings for all purposes described in this Privacy Policy.

USE OF COOKIES IN OUR SERVICES

The Services use cookies and similar technologies such as pixel tags, web beacons, log files, local storage objects, clear GIFs and JavaScript (collectively, “cookies”) to enable our servers to recognize your web browser, tell us how and when you visit and use our Services, analyze trends, learn about our user base and operate and improve our Services. Cookies are small pieces of data– usually text files – placed on your computer, tablet, phone or similar device when you use that device to access our Services. We may also supplement the information we collect from you with information received from third parties, including third parties that have placed their own cookies on your devices through the Services or otherwise.

We use the following types of cookies:

Essential cookies are required for providing you with features or services that you have requested. For example, certain cookies enable you to log into secure areas of our Services. Disabling these cookies may make certain features and services unavailable.

Functional cookies are used to record your choices and settings regarding our Services, maintain your preferences over time and recognize you when you return to our Services. These cookies help us to personalize our content for you.

Performance cookies allow us to understand how users use our Services. They do this by collecting information about the number of visitors to the Services, what pages visitors view on our Services and how long visitors are viewing pages on the Services.

Marketing/Targeted Advertising cookies collect data about your online activity and identify your interests to provide marketing or advertising that may be relevant to you. We also allow third parties to set and collect Marketing/Targeted Advertising cookies through our Services. For more information, please see the below section called, “Third-Party Resources about Cookies and to Opt-Out of Cookies and Targeted Advertising”.

“Do Not Track” Privacy Preferences

“Do Not Track” is a privacy preference that users can set in their web browsers. When a user turns on the Do Not Track signal, the browser sends a message to websites requesting them not to track the user. Our Services are not currently configured to respond to Do Not Track signals or other mechanisms that provide users the ability to exercise choice regarding the collection of Personal Information about a user’s online activities over time and across third-party websites or online services.

OUR USES OF PERSONAL INFORMATION IN THE LAST 12 MONTHS

The below chart summarizes the categories of Personal Information we have collected, disclosed to third parties, or sold or shared for cross-contextual behavioural advertising (or targeted advertising) to the identified categories of third parties within the prior 12-month period. For more details on the categories of third parties, see the above section called, “Categories of Third Parties with Whom We Share Your Personal Information”.
